TERMS & CONDITIONS

Last updated: 6 September 2026

These Terms & Conditions apply to your access to and use of pro-gram-studios.com and to products purchased through the website.

The website and Pro Gram Studios business are operated by MAG5K PTY. LTD., ABN 35 684 664 686, ACN 684 664 686, 7 Clunies Ross Court
Eight Mile Plains QLD 4113, Australia.

By accessing the Site or placing an order, you agree to these Terms & Conditions.

Nothing in these Terms excludes, restricts or modifies any consumer right, guarantee, remedy or other protection that cannot lawfully be excluded, including rights under the Australian Consumer Law and mandatory consumer laws applicable in your country.

1. USING OUR WEBSITE

You may use the Site only for lawful purposes.

You must not knowingly interfere with the operation or security of the Site, transmit malicious code, attempt unauthorised access, scrape the Site through unauthorised automated means, impersonate another person or use the Site in a way that infringes the rights of Pro Gram or another person.

We may restrict access where reasonably necessary to protect the Site, our customers or our business.

2. PRODUCTS

We make reasonable efforts to ensure product descriptions, photographs, measurements, sizing information and other details are accurate.

Colours may vary depending on your display or device, and reasonable variations may occur between individual garments and production runs.

Unless specifically stated otherwise, measurements are approximate.

We may change or discontinue products and may limit quantities available for purchase.

3. PRICES, TAXES & CURRENCY

Prices are displayed in the currency shown on the Site or at checkout.

Applicable taxes will be included or calculated as required by law.

Shipping charges and other charges payable to us will be displayed before you complete your order.

For international orders, import duties, taxes, customs charges or other government charges may apply. Unless checkout expressly states that these charges are included, you are responsible for charges imposed by the destination country.

Where an additional charge cannot reasonably be calculated in advance, we will disclose that such a charge may be payable where required by law.

Your bank or payment provider may separately charge foreign exchange or international transaction fees.

4. PLACING AN ORDER

When you place an order, you are making an offer to purchase the selected products subject to these Terms.

An automated order confirmation acknowledges that we have received your order. It does not necessarily constitute acceptance of the order.

Unless applicable law requires otherwise, we accept your order when we dispatch the products or otherwise expressly confirm acceptance.

Before acceptance, we may reject or cancel an order where reasonably necessary, including where:

  • a product is unavailable;
  • there is an obvious pricing, description or stock error;
  • payment cannot be authorised;
  • delivery to the address provided is not reasonably possible;
  • we reasonably suspect fraud or unauthorised activity;
  • purchase limits have been exceeded or circumvented; or
  • automated purchasing software or bots have been used contrary to these Terms.

If payment has already been taken for an order that we cancel, we will refund the amount paid for the affected products.

Nothing in this section allows us to cancel an accepted order in circumstances where doing so would breach applicable consumer law.

5. PAYMENT

We accept the payment methods displayed at checkout.

You must provide accurate and complete billing and payment information.

Payments may be processed by Shopify and third-party payment providers. Those providers may process payment information in accordance with their own terms and privacy practices.

We do not generally receive or store complete payment-card numbers where those details are handled directly by a payment provider.

6. SHIPPING & DELIVERY

Shipping options, charges and estimated delivery periods are displayed on the Site or at checkout.

Delivery dates are estimates unless expressly agreed otherwise.

Carrier delays, customs processing, adverse weather, public holidays, peak periods and other circumstances may affect delivery times.

Where mandatory consumer law gives you rights relating to delayed, failed or damaged delivery, those rights are not affected by these Terms.

For UK consumers, where applicable law requires it and no different delivery period has been agreed with you, goods will be delivered without undue delay and generally within 30 days.

If you provide an incorrect or incomplete delivery address, additional delivery charges may apply where lawful.

7. RETURNS, REFUNDS & CONSUMER RIGHTS

Change-of-mind returns

Unless otherwise stated on a product page or promotion, we do not voluntarily accept returns or exchanges solely because you changed your mind, ordered an incorrect size or no longer want the product.

This policy does not apply where you have a mandatory legal right to cancel or return an order.

Australian customers

Our products come with consumer guarantees that cannot be excluded under the Australian Consumer Law.

Products must, among other things, be of acceptable quality, match their description and be fit for any purpose that we represented they would be fit for.

If a product fails to meet an applicable consumer guarantee, you may be entitled to a repair, replacement, refund, compensation or another remedy depending on the circumstances and whether the failure is major or minor.

Nothing in these Terms imposes an artificial return deadline on rights that continue to apply under the Australian Consumer Law.

Where applicable law requires us to bear reasonable costs associated with returning faulty or non-conforming goods, we will do so.

United Kingdom customers — cancellation rights

If you are a consumer in the United Kingdom purchasing goods online, you generally have the statutory right to cancel an eligible purchase without giving a reason.

The cancellation period generally expires 14 days after the day on which you, or a person nominated by you other than the carrier, receives the goods.

To exercise this right, notify us clearly of your decision to cancel before the cancellation period expires.

You may contact us at:

tom@pro-gram-studios.com

After notifying us of cancellation, you must generally return the goods within 14 days.

Unless the goods are faulty, incorrectly supplied or the law requires otherwise, you are responsible for the direct cost of returning goods following a statutory change-of-mind cancellation.

We will refund payments due under the cancellation right, including the cost of our least expensive standard delivery option where required by law.

If you selected a more expensive delivery service, we are not required to refund the additional amount above the cost of standard delivery.

We may reduce a refund where permitted by law if the value of the goods has been diminished by handling beyond what is reasonably necessary to establish their nature, characteristics and functioning.

Refunds will be made without undue delay and within the period required by law. For returned goods, we may generally wait until we receive the goods back or you provide evidence that you have returned them, whichever occurs first.

The statutory cancellation right does not apply to certain categories of goods specified by law, which may include goods made to your specifications or clearly personalised and certain sealed goods that are not suitable for return for health protection or hygiene reasons once unsealed.

These cancellation rights are separate from your rights where goods are faulty, not as described or otherwise fail to conform to the contract.

United States and other customers

Customers in the United States and other jurisdictions retain any mandatory rights available under applicable federal, state or local consumer law.

Where no mandatory change-of-mind right applies, our voluntary returns policy stated above applies.

8. FAULTY, DAMAGED OR INCORRECT PRODUCTS

If you believe you have received a faulty, damaged or incorrect product, contact us with your order number and sufficient information for us to assess the issue.

We may ask for photographs or other reasonable information, but we will not impose requirements that unlawfully restrict your consumer rights.

Where a remedy is required by law, we will provide the appropriate remedy.

9. LIMITED RELEASES & PURCHASE LIMITS

Certain products may be offered in limited quantities.

Where we state a maximum quantity per customer, household, payment method or other reasonable purchasing limit, you must not deliberately circumvent that restriction.

We may cancel duplicate or excessive orders where we reasonably believe purchasing restrictions have been deliberately avoided, subject to applicable law.

10. AUTOMATED PURCHASING & BOTS

You must not use automated purchasing software, bots, scripts or other technology designed to gain an unfair purchasing advantage, circumvent quantity limits or materially interfere with the normal operation of the Site.

We may reject or cancel affected orders where reasonably necessary and permitted by law.

11. GIFT CARDS

Pro Gram gift cards are redeemable online according to the conditions displayed at the time of purchase.

Gift cards may not be redeemed for cash except where required by law.

Any expiry period, fees and other restrictions are subject to mandatory consumer law.

For gift cards supplied in Australia, we will comply with applicable Australian gift-card requirements, including minimum validity periods and restrictions on post-supply fees where those requirements apply.

12. PROMOTIONS & DISCOUNT CODES

Promotions may be subject to additional terms displayed when the promotion is offered.

Unless otherwise stated, discount codes:

  • have no cash value;
  • must be entered before checkout is completed;
  • may be limited to selected products;
  • may be limited to one use or one use per customer; and
  • may have an expiry date.

We may correct or withdraw a promotion affected by an obvious technical or pricing error, subject to applicable consumer law.

13. INTELLECTUAL PROPERTY

Unless otherwise stated, the Site and its content — including the Pro Gram name, logos, graphics, photographs, videos, artwork, product graphics, text, layout and other creative material — are owned by or licensed to Pro Gram.

You may access the Site for personal, non-commercial use.

You must not reproduce, distribute, sell, commercially exploit, modify or create derivative works from our content without written permission except where permitted by law.

14. THIRD-PARTY SERVICES

The Site may contain links to or integrations with services operated by third parties.

Those services may have separate terms and privacy policies.

We are not responsible for independent third-party websites or services that we do not control, except to the extent applicable law provides otherwise.

15. WEBSITE AVAILABILITY

We aim to keep the Site available and accurate but cannot guarantee that access will always be uninterrupted or error-free.

We may update, modify, temporarily suspend or discontinue Site functionality where reasonably necessary.

16. LIABILITY

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

In particular, nothing in these Terms excludes mandatory consumer guarantees or liability that cannot lawfully be excluded or restricted.

To the maximum extent permitted by law, we are not responsible for losses that were not reasonably foreseeable when the relevant contract was formed or that were not caused by our breach, negligence or unlawful conduct.

We do not exclude liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence where such liability cannot lawfully be excluded.

17. EVENTS OUTSIDE OUR REASONABLE CONTROL

We are not responsible for delays or failures caused by circumstances outside our reasonable control to the extent permitted by law.

This may include natural disasters, severe weather, carrier disruption, industrial action, telecommunications failures, government action, war, civil disturbance or similar events.

This section does not remove any mandatory right you may have under applicable consumer law.

18. CHANGES TO THESE TERMS

We may update these Terms from time to time.

The version applying to a purchase will generally be the version in effect when the order was placed, except where a change is required by law.

The current version and its latest update date will be published on this page.

19. GOVERNING LAW

These Terms are governed by the laws of Victoria, Australia and applicable laws of the Commonwealth of Australia.

If you are a consumer outside Australia, this clause does not deprive you of mandatory consumer protections that apply to you under the laws of your country or state and that cannot lawfully be excluded by choosing another governing law.
